The Biden administration’s challenge to Idaho’s strict abortion ban divided a federal appeals court that heard arguments Tuesday in an emergency abortion care case that has already reached the Supreme Court once.

The 9th circuit court of appeals heard arguments in Pasadena, California Tuesday in a lawsuit brought against the state of Idaho by the federal government. The case centers around whether or not the Emergency Medical Treatment and Labor Act or EMTALA conflicts with Idaho’s abortion ban.

Idaho’s ban contains an exception to save the pregnant patient’s life, but not to prevent detrimental health outcomes, including the loss of future fertility, which is a risk with severe infection or bleeding.
